Georgia appealed to ECHR in August 2008 accusing Moscow of violation of several norms of the European Convention on Human Rights and Fundamental Freedoms. The court hosted a hearing to decide whether to consider Georgia’s suit on September 22, with the following developments held secret. During the hearing Russian Deputy Justice Minister Georgi Matyushkin stated that hadn’t Georgia violated the principle of non-use of force stipulated by the UN Charter there would have been no violation of human rights in South Ossetia and Abkhazia. He insisted that South Ossetia and Abkhazia should be viewed as independent sides of the conflict since at time Russia did not have enough authority to control their military.
