MP: agreement lacks the same legal force as a treaty

PanARMENIAN.Net - MP Levon Kocharyan from the Armenia faction of the National Assembly commented on Prime Minister Nikol Pashinyan’s statement about his readiness to sign an agreement with Azerbaijan. He highlighted that there are significant differences between a treaty and an agreement in a post on his Telegram channel.

"Nikol Pashinyan says he is ready to sign an agreement between Armenia and Azerbaijan, whereas previously, the discussion was about a treaty."

From both legal and practical perspectives, there are key differences between a treaty and an agreement:

A treaty is a legally binding document that creates specific obligations for the parties involved. Failure to fulfill these obligations by any party results in legal consequences.

An agreement, on the other hand, expresses a general consensus between parties but does not carry the same legal weight. Violating it does not lead to the same consequences," he said in his post.

Prime Minister Nikol Pashinyan has repeatedly stated that the draft peace agreement between Armenia and Azerbaijan has already been agreed upon and is awaiting final signing. The Armenian Foreign Ministry has also referred to the agreement in its statements.

On March 13, the Armenian Foreign Ministry announced that it had accepted Azerbaijan’s proposals on two previously disputed articles, declaring that the peace agreement was ready for signing. Armenia has expressed readiness to discuss the timing and location of the signing. Meanwhile, Baku has introduced new preconditions, stating that it is too early to discuss a meeting date.
